Abstract:

As worries about the environment grow sustainable innovation now plays a key role in how India plans its growth. Green technologies in areas like renewable energy, waste handling, and saving resources are advancing . This progress needs strong systems to protect intellectual property to apply and promote these technologies . This study looks at how important patent drafting is to protect eco- friendly innovations in India's legal and policy setup. It studies how the careful design and strategy behind patents shape their reach, reliability, and value in the market. These factors are crucial to encourage funding and drive progress in technology.

The research uses multiple methods. It looks at the Indian Patents Act 1970, studies recent green patent filings, and reviews case studies on both successful and failed patent applications in sustainable technology. It notes key problems like how hard it is to turn technical ideas into proper patent claims, the shortage of experts who can draft claims well, and issues with the Indian patent system's process. It also shares useful practices such as writing clear claims, including detailed disclosures, and aligning strategies with both local and global patent rules.

The findings highlight the need to build stronger skills among stakeholders, boost understanding of changing patent systems, and establish better institutional support. The thesis wraps up with policy advice to improve training opportunities for patent experts, simplify procedures to examine patents related to green technologies, and create spaces to encourage sharing knowledge.
